These Terms of Service ("Terms") govern your access to and use of the website located at www.littleroadrunners.com (the "Site"), operated by Little Roadrunners Academy ("Little Roadrunners Academy," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site provides general information about Little Roadrunners Academy, a Montessori early learning center serving children from 6 weeks through age 5 in Albuquerque, New Mexico, and allows prospective families to learn about our programs, request information, and download enrollment materials.
2. Not an Enrollment Contract
Information on the Site — including program descriptions, age ranges, tuition, availability, staffing, curriculum, and schedules — is provided for general informational purposes and may change at any time without notice. Nothing on the Site constitutes an offer of enrollment or a binding contract. Enrollment, tuition, fees, and program terms are governed exclusively by the written enrollment agreement and Parent Handbook signed by the parent or legal guardian. In the event of any conflict, the signed enrollment documents control.
3. Eligible Users
The Site is intended for use by adults 18 years or older, including parents, legal guardians, and other adults acting on behalf of a child. By submitting a form or contacting us, you represent that you are at least 18 years old and legally able to provide the information submitted.
4. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Submit false, misleading, or fraudulent information through any form;
- Attempt to gain unauthorized access to any portion of the Site, its servers, or related systems;
- Interfere with, disrupt, or overload the Site or its infrastructure;
- Introduce viruses, malware, or other harmful code;
- Scrape, harvest, or collect information from the Site by automated means without written permission;
- Use the Site to harass, defame, or harm any child, family, staff member, or third party.
5. Intellectual Property
All content on the Site — including the Little Roadrunners Academy name, logo, mascot, text, graphics, photographs, illustrations, layout, and downloadable materials such as handbooks and enrollment packets — is owned by or licensed to Little Roadrunners Academy and is protected by copyright, trademark, and other intellectual property laws. You may view and download materials for your personal, non-commercial use in connection with evaluating or enrolling in our programs. Any other use, reproduction, or distribution without our prior written consent is prohibited.
6. Forms and Communications
By submitting a contact, tour, or enrollment inquiry form on the Site, you consent to being contacted by phone, email, or text at the contact information you provided regarding your inquiry, tours, enrollment, and related updates. Standard message and data rates may apply. You may opt out of non-essential communications at any time.
7. Third-Party Links and Services
The Site may contain links to third-party websites, tools, or services (for example, embedded forms, mapping services, and links to the New Mexico Early Childhood Education and Care Department). We do not control and are not responsible for the content, policies, or practices of third-party sites or services. Access is at your own risk and subject to the third party's terms and privacy policies.
8. Downloadable Documents
Parent Handbooks, enrollment packets, and other documents made available for download are provided for informational and enrollment purposes only. The most current version on file at the school controls. Please contact the Center Director to confirm you have the most recent version before signing.
9. Disclaimers
The Site and all content, materials, and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any information on the Site is complete, accurate, or current.
10. Limitation of Liability
To the fullest extent permitted by law, Little Roadrunners Academy, its owners, staff, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of the Site, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Site is limited to one hundred U.S. dollars (US $100). This section does not limit liability that cannot be limited under applicable law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Little Roadrunners Academy and its owners, staff, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Governing Law and Venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a new effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
